The terms behind the service and the software.

These terms govern your use of vbsourcecoderecovery.com, any source code recovery we perform for you, and every license of the VB Source Code Recovery software. By using the site, placing an order or installing the software you agree to them. The short version is in the box below; the rest is the detail.

In short. You must own, or hold the rights to, any program you ask us to recover or decompile. Software sales are final. A single-computer license belongs to one person; a site license belongs to one company. Recovered code is delivered as-is, with what the compiler stripped clearly marked. Our liability to you is limited to the amount you paid us. These terms are governed by Illinois law, and disputes go to the courts of DuPage County, Illinois, United States.

1. Who we are and what these terms cover

VB Source Code Recovery (vbsourcecoderecovery.com) is operated by Samson Software ("we", "us"). These terms cover the website, the free tools we publish, the source code recovery service, and the VB Source Code Recovery software, including its command-line mode and the members area that supports it. Our privacy policy explains how we handle personal data and the files you send us; it forms part of these terms.

2. Your rights to the program

Decompiling a program you do not have rights to may be unlawful and may breach that program's license. We recover source only for rights-holders. By sending us a program, or by using the software on one, you represent and warrant that you own the program, hold the rights needed to reverse engineer it, or have the owner's permission to do so, and that doing so does not breach any agreement or law that applies to you. We may ask you to confirm this in writing before work begins, and we may decline any job without giving a reason.

3. The recovery service

4. The software license

When you buy the software we grant you a non-exclusive, non-transferable license to install and use it, subject to these terms. The license is issued to the individual or the company named on the purchase, depending on what was bought:

Either license is perpetual for the versions it covers (see Activation, devices and updates). You may not sell, rent, lend, sublicense or transfer a license or an activation code; run the software as a service for third parties without a site license; remove or circumvent its activation; or copy it except as needed for installation and backup. A license key or activation code that is published, shared or resold may be revoked.

5. Activation, devices and updates

6. Payment and final sales

7. Accounts and the members area

Buying a license creates an account. You are responsible for keeping your password and license keys confidential and for everything done with them; tell us at once if you believe an account or key has been compromised. Provide accurate contact details so we can reach you about your license. We may suspend or close an account that breaches these terms, that is used to abuse the service or other customers, or whose payment has been reversed.

8. Files you send us

You may send us programs for evaluation through the quote form or our private upload page. You keep all rights in what you send; we use it only to evaluate and, if you proceed, to perform the recovery, and we handle it as described in the privacy policy. Do not send anything you do not have the right to send. We may delete uploaded files at any time after the evaluation, so keep your own copies; we are not a backup service and are not responsible for the loss of files you have not kept elsewhere.

9. Acceptable use

You agree not to use the site, the service or the software to infringe anyone's intellectual property, to break software licensing or copy protection you are not entitled to break, to develop malware, or in breach of any law; not to probe, overload or interfere with the site or the licensing servers; and not to use the members area to harass or defraud. You may not use the software to build a competing product from its output, but you are of course free to use the source you recover from your own programs in any way you wish.

10. Intellectual property

The software, the website, our recovery engine, documentation and reports are our property and are protected by copyright and other laws; a license is a right to use, not a transfer of ownership. Source code we recover from your program belongs to you, subject to your rights in the original program. We keep no rights in it and no copy of it after delivery. The free VBScanner utility is provided free of charge for your own use and may not be redistributed for a fee.

11. Disclaimer of warranties

Decompilation is a reconstruction. To the fullest extent permitted by law, the software, the site and all recovered source are provided "as is" and "as available", without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, or that recovered code will compile, be complete, or be free of errors. Our published benchmarks and evaluations describe what our engine typically achieves; they are not a promise about any particular program. Some jurisdictions do not allow certain warranties to be excluded, so parts of this section may not apply to you.

12. Limitation of liability

Our total liability to you, for all claims arising out of or relating to the site, the service, the software or these terms, whether in contract, tort (including negligence), statute or otherwise, shall not exceed the total amount you paid us for the service or license that gave rise to the claim.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or the cost of substitute goods or services, however caused and even if we were advised of the possibility. Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

13. Indemnity

You will defend, indemnify and hold us harmless from any claim, loss, damage, liability or expense (including reasonable legal fees) arising from your breach of these terms, from your lack of rights to a program you asked us to recover or used the software on, or from your use of any recovered source.

14. Termination

You may stop using the software and close your account at any time. We may suspend or terminate a license or account if you materially breach these terms and do not cure the breach within 14 days of notice, or immediately for fraud, a reversed payment, or shared or resold keys. On termination the license ends and you must stop using the software; sections 10 through 16 survive. Termination does not entitle you to a refund.

15. Governing law and jurisdiction

These terms and any dispute arising out of or relating to them, the site, the service or the software are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

The state and federal courts located in DuPage County, Illinois have exclusive jurisdiction over any such dispute, and you consent to their personal jurisdiction and to venue there. Either party may nonetheless seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.
